We wish to annouce the launching of  Legal Aid Clinic at Sungei Siput, details of which are as follows:-

The idea of setting this Clinic came about following requests from several NGOs who are serving the hard-core poor communities in the rural areas and surrounding estates in Sungei Siput.
The clinic will be manned by volunteers and pupils and shall initially operate on a bi-monthly basis, subject to public demand.

LEGAL AID WORKSHOP

Theme: LEGAL AID – THE NEXT GENERATION

Thirty lawyers and pupils participated in a one-day Legal Aid workshop themed Legal Aid-The Next Generation held on 09.12.11 at the Perak Bar Conference Room.

In his opening address N.P Ramachandran, the Deputy-Chair reminded the participants of the importance of being volunteers as it is literally impossible to imagine a social justice landscape without the services that the legal aid provides.

The first topic was History of Legal Aid In Malaysia where Mr. Ram , the EO for Perak Bar Legal Aid Centre spoke on the origins of Legal Aid in Malaysia and how it evolved to where it is now. He mentioned about the sacrifices and hardwork of our predecessors in the hope that it will encourage the next generation to carry on.

This was followed by the next speaker En. Syamshul Hizri who presented his topic entitled The future of Legal Aid In Malaysia. The participants were awed by his topic as he highlighted the need to include animal-rights/welfare, to complement human-rights, as an extension of legal aid work.

The program resumed after morning-break with the next speaker Balakrishna Balaravi who conducted his topic on the Extension of Legal Aid Work. His method was very innovative as he began with an ice-breaker session to loosen-up the participants. Soon everyone was ready to perceive his ideas and values.

The fourth topic How to Attract Volunteers Laywers was conducted by Nurul Jannah Khairul Anuar. She suggested several time-tested methods in luring volunteers with the same goal, much to everyone’s excitement ie remuneration.

The workshop resumed after lunch where the participants were formed into four groups, each with its own tagline viz ‘Thunder cats, 1 Malaysia, LAC Superheroes and Red. They were requested to submit resolutions based on the 3 major topics of the day.

This was later followed by summary presentations by each group. Laughter and jest followed as each group made its way to the fore to present their resolutions. Later, Mr. Ram also announced news of the opening of our new Legal Aid Clinic in Sungei Siput (date TBC) and managed to get 11 lawyers and pupils sign up for this bi-monthly clinic. The Workshop ended with presentation of token of appreciation to the speakers and Certificate of Attendance to all participants. Mr. Ram thanked everyone for their participation and making the workshop a huge success. Special thanks was also conveyed to a participant from Penang Bar. Everyone left shortly after tea-time.

Perak Bar would like to extend its deepest condolences to our member Cheah Sau Voon and his family for the passing of his father on the 19th December 2011.

Wake will be held from the 20th December onwards at No.133, Jalan Pengkalan Barat 32, 31650 Ipoh and the funeral will be on the 22nd December 2011.

Cortege will be leaving the house on the 22nd December to Kek Lok Seah, Bercham at 1pm.

May he rest in peace.

Perak-Penang Bar Games - Day 1

Perak took on Penang in Futsal the opening game of the 2011 games.

Perak had only 7 players to start with and of the 7 - 5 were veteran football players. Our starting line up was Kenny (GK), Nahtan, Kiko, Elanggovan, Fuaad, Fey Aqis, Nicky. With no subs till halfway through the 1st 3rd.

Penang had almost 20 players to have an abundant number of running subs.

Perak drew first blood and scored first in the first 3rd of the game with a poachers goal by Elanggovan. Penang managed to equalise but Perak just managed to edge back in front just before the first 3rd finished with wonderful goal by Nicky Chen from an acute angle.

Penang took the reins in the 2nd 3rd and managed to equalise at 2-2. But before the Penang team could settle down, Kiko popped up and scored a goal with the flick of his foot after chasing down a through pass to take us to 3-2.

From then on Perak kept control of the game and the midfield to deny the Penang players time on the ball. Whilst the 2 chambees ran them haggard chasing every ball down.

Remi, one of the chambees took control of the through pass by Kiko in the final 3rd to score the 4th goal and ensured that Perak took the first point and took home the Thinakaran Futsal Throphy in memory of the late Thinakaran who left us suddenly 3 years ago.

Well done Futsal team! Well done Perak Bar. Maybe we had an "extra man" as we felt the presence of Thina's spirit with us defending the Perak Bar Goal!

Success In Law: Yours For The Taking - Brendan Navin Siva

The last time I gave a talk at the Ethics luncheon was exactly one year ago — I delivered the June 2010 luncheon talk. A transcript of that speech was published in LoyarBurok in June 2010 and in Praxis in the first quarter of 2011. Google the words “Of Sunscreen, Blackberries and Successful Lawyers” and you will find it on the internet.

Most of what I said then is still applicable now. So please try to get it and see whether there is anything useful there for you. Back then, I spoke about 10 specific things that I believed you ought to work on to make yourselves a good lawyer. But nothing I said there should be taken as absolute truths and nothing I say today should be taken as absolute truths – they are just my views and my perspective – it may be useful to you or it may not – that is entirely up to you.

Today I want to speak more generally about success and successful lawyers.

Throughout my very short career as a lawyer, I have witnessed and observed many lawyers come and go. Some excel, some don’t.

Some excel from the very beginning while others take a bit of time to get on their feet. I have seen some pupils come in on the first day as accomplished individuals with the right attitude and I have seen some pupils take 9 months to gradually learn how to be an accomplished lawyer.

I have also seen individuals who spend 1 or 2 years floundering and wandering aimlessly until one day a spark lights up in them and they suddenly transform into accomplished lawyers.

Sadly, I have also seen many who never actually make it at all. Many leave the profession too early before they hit their stride or before they have had the opportunity to become good lawyers.

Why do some people start off as accomplished lawyers and others take time? Why is it that some people suddenly blossom into good lawyers? There is no clear answer to these questions. And there isn’t one single piece of advice I can give you today that will trigger an inner awakening in you and transform you into an accomplished and successful lawyer.

It is all about you.

Success in law is yours for the taking. But YOU must want to succeed. And you must first realize that success doesn’t come to the guy by the side of the road waiting for something to happen. It comes to the guy who is out there looking for it. Success does not come knocking on your door and waits for you to answer. It comes to the guy who is first in line at the door.

The trigger point is when you realize and accept that what YOU become in life and how successful YOU become is mainly dependent on what YOU do and how much work and time YOU are prepared to put into achieving success. Are YOU willing to do what the average person is not willing to do? Are YOU willing to put in the excruciatingly long hours to gain the knowledge and experience required to succeed in law? Are YOU willing to put in the extra hours to learn more about a particular area of law than any other lawyer? Are YOU willing to put in the time to learn how to market yourself professionally? Are YOU willing to put in the extra effort to speak eloquently and write well?

When you are ready to say yes to those questions, then I believe you are on the right track.

These are not just questions for a young lawyer or pupil. I still ask myself these questions. Every lawyer must keep asking himself or herself these questions. The most successful lawyers in this country and in the world are not relaxing at home on the weekends – they are working hard. I know the top 5 litigators and the top 5 corporate lawyers in Malaysia – they have worked very hard to get where they are today and they continue to work hard every day.

Some of you have already asked yourselves this question. That is why you are already on the right track. What is the right track?

From my perspective, when I see a pupil spend hours on a piece of research and is able to come back to me with an answer and is able to defend that answer and argue with me on the merits of that answer, he or she is on the right track.

When a lawyer can speak to me or to a judicial officer or to a client in a manner and in a tone that exudes confidence and assures me that he or she knows the law and can persuade me that her solution or understanding of the law is the correct one, he or she is on the right track.

When a young lawyer is able to follow me for meetings with clients and is able thereafter to deal with the client and answer the client’s queries, he or she is on the right track.

When a lawyer can come up to me and tell me she would like to attend this conference or that seminar or that she would like the firm to buy this book or that book because it will enhance her knowledge in a particular area of law and this would benefit the law firm, that person is on the right track.

In short, you are on the right track if you conduct yourself as a LAWYER and not as an employee. What do I mean by this?

In your first few years, most of you will probably be an employee – a legal assistant – someone who assists the partner or senior lawyer to generate fees for the law firm. But eventually you will have to be the FEE EARNER – the person who the client comes to and gives a brief to and is prepared to pay fees to do his brief. Accept this fact as reality – a successful lawyer is a FEE EARNER – someone that clients WANT to engage to do their work – not because of the name of the law firm or the name of some other person in your law firm. They want to engage YOU.

You must work out from Day One what needs to be done to become a FEE EARNER – again, I repeat – someone that clients WANT to engage – What differentiates you from any other lawyer? What level of service can you provide that the person sitting next to you now cannot provide? Focus on this. Focus on being a FEE Earner – a good lawyer that clients want to engage.

Don’t focus on your bonus for this year or why your room is so small or why that other lawyer in your firm is doing less work than you but earning more than you or why you have to do more mentions than that other lawyer.

Don’t complain about how much the firm is using you, focus on how much you can use the firm as a platform for you to become a fee earner.

A person on the right track will equip themselves with the knowledge and the ability to be a strong FEE Earner. A strong Fee Earner can go out on his own and start his own legal practice or join another law firm and be a successful lawyer. He is not beholden or dependent on the law firm. The law firm is dependent on him or her. The law firm will want to make you a partner.

When you are on the right track, I assure you that there will be many many different options and opportunities that will come your way, all of which promise, and carry the potential for, success. But first you must ask yourself at this point in time – as you are just about to embark on your career – Are YOU prepared to INVEST in yourself?

Change of Bar Council Malaysia's Phone Numbers

Please be informed that Bar Council Malaysia’s new general number is 03-2050 2050, effective immediately. The old hunting line (03-2031 3003) will be phased out tomorrow (13 July 2011). The fax numbers remain unchanged.

The new telephone system includes features such as multi-level auto attendant, voicemail, call forwarding and call recording, which will enable callers to reach specific departments more easily.

The recording of all incoming and outgoing calls will allow staff performance to be monitored for quality assurance and training purposes.

Funeral service will be held at his residence at No. 14, Jalan Bulan, Sunrise Garden (Westpool Park), Kampung Simee, Perak Darul Ridzuan on 07th July 2011 (Thursday) whilst the cortege will be leaving for the Buntong Crematorium at about 4.00 pm on the same day.

Our football team opened the tournament with a narrow win on penalties against PDRM. Norali, the new Perak Bar number 9 scored on his debut and our keeper Justin was the hero of the game where he saved the last penalty on sudden death. However, due to lack of players because of multiple injuries and other prior commitments, Perak Bar suffered heavy defeat of 1-5 against the Bench whereby Ellangovan provided us the consolation goal in the second half. The score would have been better had Perak Bar started with the full 11 players instead of just 10. In the final game, the Bench defeated PDRM 3-2 in a high tension game. Overall result for football, the Bench retained the championship, followed by Perak Bar and PDRM. I would like to thank our Perak Bar Chairman Haji Mad Diah for his presence throughout both games to cheer our players on as well as to Danial Rahman for shaking off the cobwebs of his boots to play for the team.

BOWLING

The format of the game is 10 players from each team, comprising of 5 ladies and 5 men. It was evident from the games that both PDRM and Bench bowl like professional bowlers at par; if not similar, to our skill in drafting an Affidavit of service. The bench won this event with total pinfall of 3720 slightly edging out PDRM who finished with 3712 whereby our Perak Bar team scored a total of 2932 pinfalls only. I would like to congratulate Zaireen for her participation in this event.

NETBALL

Before we reveal the score, kudos to our netballers for the team spirit, to come and fight as one and to organise their preparation diligently. I’ve witnessed the first game against the PDRM whereby our Perak Bar Team gave PDRM a good fight before finally losing 4-11. This is reasonable score compared to the other game whereby PDRM thrashed the Bench 13-1. The Bar however managed to edge out the Bench 8-5 in the other round robin game. Therefore overall for Netball PDRM is the winner, Perak Bar comes in 2^nd and the Bench 3^rd.

VOLLEYBALL

Without training, our Perak Bar team lost both games against Bench and PDRM. Against PDRM we managed to give reasonable fight considering some of the players only just got to know each other in that particular morning itself. I would like to congratulate Adham Jamalullail for being the captain and manage to bring more than 6 players for the game and Rehan for playing for the volleyball team. According to our Captain, with more training this team can click and play well. PDRM is the overall winner, followed by the Bench and Perak Bar.

BADMINTON

Our Captain, K. Y. Chong is a Superman. Our Tuan Haji Khairil is also an equal to Batman. Both players played in almost every men double games for the Perak Bar team. This is due to the last minute absence of most Perak Bar star shuttlers on that particular day. PDRM is the winner, Bench 2^nd and Perak Bar 3^rd.

DARTS

This is the game Perak Bar nearly won. We lost by 1 point to PDRM and lead the Bench by 3 points. I must thank Kenny Lai for his presence and participation for our Perak Bar team. Out of all the sports, this is the game whereby our player, Kiko Das, will go on stage to claim the overall best individual scores of 120.

Finally I would like to congratulate all members and the Main Committee who took part and further eased my burden in organizing this event. Irrespective of the outcome of shooting, which will be held on 17.6.2011, PDRM is already the overall winner of this tournament followed by Bench and Perak Bar. I hope in future, more members will come and join not only in sports but also in other programmes organised by the members of the Perak Bar Committee for their benefit to foster better relations and camaraderie as well as to have fun! Well done and Thank you Perak Bar!

Perak Bar in action in 3 games today vs. PDRM.

Netball - Perak Bar fought valiantly but unfortunately succumbed to PDRM 4-11. Hard Luck ladies... Win the next one vs. Court!

Football - Perak Bar took the lead against the fitter PDRM into Half Time but could not hold on to the lead after the restart. Full time ended in. 1-1 draw which lead to penalties to determine who will take the extra point.

Perak Bar won the penalty shootout 8-7 with our Justin 'safe hands' saving the 8th penalty by the PDRM. Well done boys! One down One to go!

Bowling - will be held tonight at Ampang Bowl at 8pm. Be there or be square.

Civil Procedure-Stay of Execution-Summary Judgment-Error in granting Summary Judgment admitted in Grounds of Judgment-Whether a occasion of special circumstances.

Brief Facts

Summary Judgment was entered on 7.12.2009. An appeal was lodged to the Court of Appeal. In the grounds of judgment, the trial judge kindly admitted that the Summary Judgment was granted in error. The learned trial judge proceeded to both identify issues to be tried and under the 2^nd limb of RHC O14 r3(1) the existence of some other reason for the trial of the action.

Counsel for the Defendant naturally relied on the grounds and argued that there exists special circumstance to justify a stay of execution pending appeal.

The celebrated High Court decision in Leong Poh Shee v Ng Kat Chong [1966] 1 MLJ 86 where Raja Azlan Shah J (as his lordship then was) was refereed to, where the following paragraph was commended to the court:-

“Special circumstances, as the circumstances implies, must be special under the circumstances as distinguished from ordinary circumstances. It must be something exceptional in character, something which exceeds or excels in some way that which is usual or common”.

Counsel further submitted that a refusal to grant a stay of execution is akin to issuing a license to the Plaintiff to issue execution based on a Judgment whose propriety is disputed even by the trial Judge.

In reply counsel for the Plaintiff asserted that such error even if true does not constitute an occasion of special circumstance. The Plaintiff relied on the High Court decision in Paranchothi K Ramalingam & Or v Sentul Raya Sdn Bhd [2007] 10 CLJ 421.

In the Paranchoti case, the Judge after granting a Summary Judgment admitted in the grounds that the Judgment was granted in error. The Defendant filed an application to set aside the judgment and/or to in invoking the “slip rule” to amend the Judgment to reflect the opinion expressed by the Judge in the Grounds. The Application was dismissed.

The High Court ruled, correctly, that the slip rule has no application to the facts of the matter. The High Court nonetheless opined that the Grounds of Judgment provides a cogent basis for the Appeal at the Court of Appeal on the existence of issues to be tried.

On the other hand, the High Court accepted the submission by the Plaintiff that even with the admission of error by the learned Judge, it is foreseeable that the Court of Appeal may disagree with the High Court and sustain the Summary Judgment in spite of the Grounds.

The Plaintiff counsel further made a tactical decision not to contest the stay per se but to invite the Court to order a conditional stay on the terms that the entire Judgment debt be paid to the joint account of the Solicitors.

Judgment of Termizi JC

In his lordship’s oral judgment, the High Court ruled that the kind admission of error by the Trial Judge constitute an occasion of special circumstances warranting a stay. The Court also took into account that the short date of the Appeal to the Court of Appeal.

Commentary

It must be noted that the Plaintiff counsel made a tactically sound decision to invite the court to grant a conditional stay and not contest the application outright.

Despite this decision, the Author commends the High Court for ruling that an error in granting a Summary Judgment is an occasion of special circumstance. A look at the journals indicate that this specific point appears not to have been considered before. On one hand, perhaps because it appears too obvious that such error would warrant a stay but nonetheless by this Judgment, the Ipoh High Court has made a ruling as to what constitutes an occasion of special circumstances.

LAW AWARENESS BOOTH AT TANJUNG TUALANG ON 17.04.11

Men Against Violence (MAV) began in 2010 by Sekretariat Pembangunan Masyarakat dan Sosial Pergerakan Masyarakat Wanita UMNO Negeri Perak and a small group of NGOs, whose mission was to affect social change in the community by making men aware of the prevalence of violence against women. It was officially launched last year by the Menteri Besar of Perak. The concept was to develop creative and targeted marketing, education and communication tools to deliver the message that the issue was indeed a man's issue as much as a woman's, since the majority of all violent crimes against women are perpetrated by men.

Since that time, MAV has taken on a road-show concept and has become an annual affair and this year it was held in Tanjong Tualang on 17.04.11. The event was officially opened by Malaysia’s most well-known social activist Datuk Paduka Marina Mahathir. This is a lady most Malaysians speak of in glowing terms regarding her refreshingly fair liberalism, intelligence, opinionated stance and her drive to create awareness for a number of serious issues in this country. She has the interest of the community at heart with her involvement in raising awareness for AIDS, women’s rights and violence against women, as well as being a member of the National Women’s Advisory Council.

Perak Legal Aid Centre was among the several organizations invited to set up information booths to reach out to the public at large and to act as a social-change-agent to achieve a sense of community and responsibility among men and to engage them in the anti-violence movement. Its Executive Legal Officer, Mr. M. Gokoolaram Naidu also spoke and shared his experience on Domestic Violence as a panelist in the Forum entitled “Hentikan, Kawal Diri, Gunakan Fikiran”. Cultural performance by various local artists also focused on the theme of the day thus making the event more meaningful. The Perak Legal Aid Booth was manned by Puan Noorehan Zakaria along with 8 chambering students. Looking at the turn-out of visitors at the booths, the public seemed receptive to the issue in hand and also of their rights. Later, Datuk Paduka Marina presented Certificates of Appreciation to all participants.

According to sources, violence against women is on the rise with the largest increase found in the offences of intimidation. Thus this program is focused on educating both men and women on the problem of violence against women and how they can play a positive role in ending it.

Briefing on Yayasan Bantuan Guaman Kebangsaan

The Yayasan Bantuan Guaman Kebangsaan (YBGK) will be officially launched by the Prime Minister at 9 am on 25 February 2011. The YBGK will provide legal assistance to all Malaysians at the police station, the remand hearing and when they are charged in court. (in line with s28A CPC). The scheme is only for criminal cases (syariah as included).

Insofar as hearings are concerned legal assistance will only be provided to those who pass a means test. Lawyers who do YBGK work will be remunerated according a scale which will be dissussed at the briefing.

The YBGK will need to work closely with the Bar Council Legal Aid Centres in order to provide this legal assistance. We thus need to have an indepth discussion with representatives of all Legal Aid Centres about the YBGK and how this new system will operate.

It is for this reason that the Chairman Haji Mad Diah Endut would like to meet and brief volunteers practising criminal law. The briefing and discussion will take place as follows:

NEW CIVIL COURT (NCvC)

Beginning January 2011, The courts will be implementing the New Civil Courts to ensure to reduce the waiting period and to ensure the disposal of cases be speedier as well as to go digital from registration to hearings to increase efficiency and effectiveness.

Group Photograph and Farewell Hi-Tea for Yang Arif Dato' Wan Afrah binti Dato' Paduka Wan Ibrahim

The Perak Bar Committee will be organizing a group photograph session with the Judges and Registrars from both the Ipoh High Court and Lower Court at the High Court compound on 17.12.2010 at 2.45pm.

To enable the committee to make suitable arrangements for the said photography session we would be pleased to receive early confirmation of your attendance on the said date, preferably at the latest by 15.12.2010. Members interested in obtaining copies of the said group photo may also do so by contacting our Ms Charen/Ms Henna at the Perak Bar.

A farewell hi tea for Yang Arif Dato’ Wan Afrah binti Dato’ Paduka Wan Ibrahim will follow at the Royal Ipoh Club after the said photography session between 3.00 to 5.00pm.

Annual Dinner 2010 Report

The Perak Bar Annual Dinner was held on 27th November, 2010 at Le View Syuen Hotel. This year the social sub committee came up with a theme "Retro Chic". The night was a resounding success with members who came dressed conforming to the theme. We had the male population who came dressed, from the legendary Sarip Dol to Starsky and Hutch. Whilst the female came in scales, neon bright colours and beehives! I must say, even our Mr Chairman's hat that night was pretty cool in keeping with the retro vibe.

Our emcees for the night were the bewitching Ms Amber Tan (with neon pink tights) and the dashing En. Ahmad Yani (with his retro batik prints).

The night was also enlivened by performance from Aris Ariwatan and the Permata Band. Audiences were tickled pink when YB Thomas Su and the gang were called on stage. We also had our very own talented members now famously known as "Kugiran Rambut Panjang (Belah Tepi)" who made their debut that night. I was informed that they are now invited to perform at other state bar functions.

The luckiest person that night is En. Norazali Nordin aka Azali Arumugam (Alleycat) who won the 40 inch LCD and the 2D1N stay in Penang.

I would like to take this opportunity to extend my heartfelt gratitude to all who attended. Special thanks to my sub committee members and chambering pupils for sacrificing their time, money and energy in ensuring that the annual dinner was a success.

OBITUARY : MR. LOH POH SENG

Please be informed that our senior member Mr. Loh Poh Seng has passed away on 8th December 2010 @ 10.00 pm.

The wake ceremony will be held at 8.00 pm at his residence No. 18, Hala Raja Dihilir Ipoh, Tambun Road, Ipoh, Perak Darul Ridzuan and the funeral service will be held on 11th December 2010 (Saturday) at 10.00 am at Christian Kinta Tambun Cemetery.
